The court recognized the decision of the National Council on warning the TVRC “Dyvosvit” (the call sign “Vesti. Radio”) to be legitimate
The District Administrative Court of the City of Kyiv, which had considered the case on the claim of the LLC “TV and Radio Company “Dyvosvit” versus the National Council of Television and Radio Broadcasting on recognition of illegal nature and cancellation of the Decision No. 2482 of 24 November 2016 which sanctioned the licensee with the “warning”, on 16 February 2017 decided to dismiss the claims of the company.
Thus, imposing the “warning” sanction on the broadcaster by the Regulator as a consequence of violations of the provisions of paragraph 13 of part 2 of Article 6 and of part 2 of Article 62 of the Law of Ukraine “On Television and Radio” was recognized to be legitimate.
We would like to recall that the National Council imposed this sanctions on the broadcaster due to the use of offensive language during the live broadcast. In the programme “People say”, the guest of which was Mrs Tetyana Montyan, there were heard rude and derogatory remarks addressed to the heroes of the Revolution of Dignity. The TV host did not respond to these offensive swearwords, and thus violated journalistic standards.
As of 16 February 2017, the LLC “TV and Radio Company “Dyvosvit” has been imposed with four “warning” sanctions that are still valid and have not been cancelled by judicial means.
On 16 February the Decree of the Frankivsk District Court of the City of Lviv on ensuring the claim of the citizen Bondareva Nadiia the Regulatory Authority was caused to postpone consideration of the issue on the extension of this broadcaster’s license. It is noteworthy that the claim was considered incredibly rapidly, especially in the realities of the Ukrainian courts work. The claim was submitted on 15 February, and on the same day the consideration of the application on the claim took place and the relevant decree was issued. Furthermore, in the early morning on 16 February this decision together with the cover letter of the company was filed by its representative to the National Council. At its meeting on 16 February the Regulator stated that due to the numerous violations of the provisions of the law it will appeal to the High Qualification Commission of Judges of Ukraine and the enforcement bodies. However, being law-abiding the Regulatory did not consider the application of the LLC “TVRC “Dyvosvit”.
