There are no legal grounds for retransmission of the foreign programme services “LoLo Baltic” and “Pro 100tv Baltic” in Ukraine
The National Council came to this conclusion, having received an official response from the National Electronic Mass Media Council (NEPLP) of the Republic of Latvia.
The company “Ltd Teledistribution Latvijas filiale” (the Republic of Latvia) applied to the National Council of Television and Radio Broadcasting with a request to include the TV programme services “LoLo Baltic” and “Pro 100tv Baltic” into the List of foreign programmes, the content of which meets the requirements of th European Convention on Transfrontier Television and the legislation of Ukraine.
Since withtn analysis of the documents submitted by the company “Ltd Teledistribution Latvijas filiale” there appeared a need of obtaining further additional information concerning the TV programme services “LoLo Baltic” and “Pro 100tv Baltic”, including concerning the legal status of their licenses issued by the national licensing authority of Latvia, ownership data, broadcasting territory, language, European works, etc., the National Council being guided by the principles of cooperation enshrined in the European Convention on Transfrontier Television addressed the NEPLP with the official request for obtaining the information.
In its response the Latvian Regulator confirmed the fact of issuance of the licenses to the company “Ltd Teledistribution Latvijas filiale” for broadcasting TV channels “LoLo Baltic” and “Pro 100tv Baltic” and listed the legal aspects with regard to their transmission. According to the provisions of the Latvian legislation the licenses of “LoLo Baltic” and “Pro 100tv Baltic” provide for the right of dissemination of regional TV programme services via cable networks and Internet exceptionally in the territory of Latvia.
Consequently, taking into consideration the official clarifications of the NEPLP the National Council informs the market players that there no legal grounds for retransmission of the TV programme services “LoLo Baltic” and “Pro 100tv Baltic” in the territory of Ukraine.
