The third cycle of submission information on the ownership structure lasts until 31 March 2019
The National Council reminds broadcasters and programme service providers that, in accordance with the Article 12, part two of the Article 59, part nine of the Article 40 of the Law of Ukraine “On Television and Radio Broadcasting”, the Procedure for submission of information on the ownership structure by broadcasters and programme service providers (hereinafter – the Procedure ) approved by the decision of the National Council of Ukraine on Television and Radio Broadcasting No 2 of January 21, 2016, registered with the Ministry of Justice of Ukraine under № 251/28381 on February 17, 2016 (as amended), entities of information activities should submit a 2018 report on their ownership structure by March 31, 2019.
Due to the amendments to the Procedure, introduced at the end of December 2017, the Regulatory Authority introduces submission of annual information on the ownership structure of entities of information activities via the module of the official website of the National Council.
Information on the ownership structure, in accordance with the legal provisions, must be submitted by March 31, 2018, in paper and electronic forms. The amendments to the Preocedure stipulate that “Electronic documents can be sent via e-mail, the address is placed on the official website of the National Council, or via the module of the official website of the National Council.” Thus, documents (information) on the ownership structure will be considered by the National Council after receipt of a paper copy.
Reports on the ownership structure that will be received by the National Council after March 31, 2019 will be considered as untimely submitted.
For a failure to submit or for a late submission of information provided for in Article 59 (second paragraph, for television broadcasting organizations) or part nine of Article 40 (for programme service providers) of the Law of Ukraine “On Television and Radio Broadcasting”, the broadcasting organization or provider of programme services shall pay a fine of 5 percent of the total amount of the license fee for all licenses owned by the offender.
