The President of Ukraine signed the law on issuance of temporary permits for broadcasting in the territory of the Anti-Terrorist Operation and border areas
On 9th January the President of Ukraine signed the Law of Ukraine “On Amending Certain Laws of Ukraine on Temporary Permits for Broadcasting in the territory of the Anti-Terrorist Operation and Border Districts of Ukraine”.
The Law introduces the procedure for issuance of temporary permits for broadcasting in the territories with the special broadcasting regime, inter alia those bordering on the temporarily occupied territories of Ukraine – the Autonomous Republic of Crimea and the City of Sevastopol, certain districts of Donetsk and Luhansk Regions, as well as border areas of Ukraine, which are covered with programmes of the aggressor state by means of broadcasting equipment from the territories of the border states.
Thus, the expanded remit of the National Council now includes the authority to issue temporary permits for broadcasting.
Such permits for temporary broadcasting will be issued by the National Council without competition (upon application) and free of charge for up to one year. The regulator is to determine the procedures for issuance and ceasing of a permit for temporary broadcasting, its terms and conditions, as well as procedures for supervision over broadcasters which provide such temporary broadcasting. An estimated calculation of frequencies for temporary broadcasting and provision of relevant opinions will be carried out by the Ukrainian State Centre of Radio Frequencies at the request of the National Council.
The Law also amends the Laws of Ukraine “On Television and Radio Broadcasting” and “On Radio Frequency Resource of Ukraine” by enshrining mechanism of issuance of temporary permits for broadcasting and defining the notions “temporary broadcasting”, “permit for temporary broadcasting”, “territories with the special broadcasting regime”.
The Law of Ukraine “On Amending Certain Laws of Ukraine on Temporary Permits for Broadcasting in the territory of the Anti-Terrorist Operation and Border Districts of Ukraine” was adopted by the Parliament of Ukraine on 7th December, 2017.
