Three more foreign TV channels can be retransmitted in the networks of cable operators
On October 11, after reviewing the appeals of the foreign companies, the National Council decided to acknowledge the three television programs:“WNESSTV”, “Shorts TV” and “Barely Legal” as such that are allowed for retransmission in the territory of Ukraine. Changes have been made to the List of foreign programs, the content of which conforms to the requirements of the European Convention on Transfrontier Television and of the legislation of Ukraine.
As regarding the TV channels “WNESSTV” and “Shorts TV” appeals to to the National Council were made by the director of the company “Efficiency First Media” I. Todorov, the Republic of Bulgaria, and by “MGB Ukraine Ltd.”, Kyiv.
The foreign program “WNESSTV” (the broadcasting company “Efficiency First Media”, TV broadcasting license of the Council of the electronic media of the Republic of Bulgaria) offers broadcasts on a healthy lifestyle in the Bulgarian language. Monitoring by the National Council recorded that the channel broadcast ads targeted for Bulgarian audience (the language of ads – Bulgarian). The signal is transmitted to the territory of Ukraine via Eutelsat 16A satellite and the IP-stream.
TV channel “Shorts TV” (the broadcasting company “Shorts International Limited” (UK), licensed by the British regulator OFCOM) airs short films in English. Representatives of the broadcaster assured the National Council in their letter, that they are familiar with the peculiarities of the legislation of Ukraine with regard to the procedure for the broadcasting/retransmission of audiovisual works on the territory of Ukraine. There are no ads on the said channel. The TV channel signal is distributed through Telstar 12 and IPTV.
Both foreign programs broadcast 24 hours a day. During their monitoring, no erotic or sexual content was recorded, neither shows with scenes of excessive violence or horror, nor films, distribution of which is prohibited in the territory of Ukraine.
Moreover, the Regulator received appeal from the “Sapphire Media International B.V.” (Amsterdam, the Netherlands) with the proposal to recognize the contents of the foreign program “Barely Legal” as being in line with the requirements of the European Convention on Transfrontier Television and of the current legislation of Ukraine. The program’s format is erotic, the language of programming is English. During the broadcast transmission, both the age markers for the classification of video products and icons of the content characteristics of the Kijkwizer classification system (Nicam, the Netherlands) are used. Advertising and other commercial information was not recorded during monitoring. Delivery of the signal to the territory of Ukraine is executed via the satellite transponder Eutelsat 16A, the signal is coded. Taking into account the Memorandum on the protection of minors in the provision of program services and requirements of the Article 13 of the Law of Ukraine “On the Protection of Public Morality”, the broadcast of this program is allowed from 12 till 4 am.
